The general terms and conditions of sale apply to all offers, purchases, and deliveries from the seller to the buyer, unless modified by mutual agreement expressly confirmed in writing by both parties. In the event that the buyer’s purchase terms conflict with the general terms and conditions of sale of MACONAL, only the latter shall apply. Agreements and commitments, whether or not deviating from these terms and conditions of sale, made by the seller’s representatives or staff, shall only be binding on the seller if expressly confirmed in writing by the latter.
MACONAL is accessible only to traders with a VAT number and VAT-registered entities. MACONAL does not sell to private individuals.
Our offers are valid while stocks last, in good condition aside from any printing errors, and are sold in standard quantities. Price changes due to government measures are reserved.
Our invoices are payable in full and without discount at the time the invoice is issued, unless otherwise stated on the invoice. In some cases, the invoice is payable 8 days after the invoice date. In the event of full or partial non-payment of the invoice on its due date, the invoice amount will automatically and without notice be increased by an interest of 1.5% per month and a flat-rate compensation of 15%, with a minimum of 50 EUR as the customer’s contribution to administrative and other costs caused by late payment.
For the establishment in Brussels, only the courts of Brussels have jurisdiction.
For the establishment in Ghent, only the courts of Ghent have jurisdiction.
Belgian law is applicable.
The goods will only become the property of the buyer after full payment of the invoice amount. In case of non-payment, the seller has the right, without court intervention, to reclaim the goods.
Any complaint regarding the (delivered) goods or services rendered must be submitted in writing within 5 days of receipt of the invoice. Complaints do not relieve the buyer of the agreed payment obligations within the period set in the terms and conditions of sale and do not constitute grounds for the reimbursement of paid amounts.
If the complaint(s) are found to be justified, the seller will notify the buyer and will have the right to either offer the claimed goods or credit the buyer for at most the invoice value, without being liable for any other or additional compensation. Returns can only be made with the consent of the seller / MACONAL. MACONAL reserves the right to accept returns of certain products. Products whose packaging has been opened are immediately payable and will be invoiced.
When goods are delivered by MACONAL, the price is determined on the day of payment. This date will also appear on the invoice. It is not the date of delivery that counts, for example, for the application of catalog prices. MACONAL reserves the right to refuse customers for the delivery of products.
